Overtime Exemption Classifications
All employment positions are determined by NPC to be either exempt or non-exempt from the overtime provisions of the Fair Labor Standards Act (FLSA)
Exempt
Positions which, based on duties performed and the manner of compensation, have been determined to be exempt from (not covered by) the payment of overtime, and are paid a salary.
Non-Exempt
Positions which, based on duties performed, have been determined to be covered by the overtime provisions of the FLSA. Employees occupying non-exempt positions must be paid one and one-half times the employee’s regular rate of pay for each ¼ hour worked in excess of 40 hours in any work week.
Professional Non-Exempt
Positions which, based on duties performed and compensation level, have been determined to be covered by the overtime provisions of the FLSA and are paid a salary and receive exempt benefits. Employees occupying Professional Non-Exempt positions must be paid one and one-half times the employee’s regular rate of pay for each ¼ hour worked in excess of 40 hours in any work week.
Administrators
Deans, directors, controller, and administrators are exempt positions which, based on duties performed and the manner of compensation, have been determined to be exempt from the payment of overtime, and are paid a salary. Deans, directors, the controller, and administrators may be dismissed from employment at any time without cause.
Employment Classifications
All employment positions with NPC are covered by one of the following employment classifications:
Regular
A position which is contracted to work part- or full-time every pay period for nine months or more during a fiscal year.
Temporary
Positions scheduled part- or full-time for a fixed period of time with no expectation of continued employment.
Federal Work Study
A non-budgeted position scheduled part-time for a fixed period of time and filled by students being paid through the Federal Work Study program.
Work Hours Classifications
All employment positions with NPC are also covered by one of the following work hours classifications as defined by the IRS:
Full-Time
A full-time position is a position scheduled on a regular, temporary, or seasonal basis:
- 30 or more hours per work week including paid time off.
- 130 or more hours per calendar month including paid time off.
- 1560 or more hours per 12-month period including paid time off.
Part-Time
A part-time position is a position scheduled for no more than 29 hours per work week on a regular, temporary or seasonal basis.
Application of Classifications
Following are the specific applications of the Employment Duration and Work Hours classifications to employees of NPC.
Regular Positions
Regular, Full-Time: A position which is contracted to work 9, 10, 11, or 12 months per fiscal year and scheduled to work a fixed number of hours between 30 and 40 each work week for the contract period. Employees occupying regular, full-time positions are eligible for full employee benefits including medical coverage. An individual who has been employed in a regular, full-time position with NPC and who separates from service with NPC may not be employed in any other position (other than another regular, full-time position) with NPC until after a break in service of at least 26 work weeks occurs.
Regular, Part-Time: A position which is contracted to work 9, 10, 11, or 12 months per fiscal year and scheduled to work a fixed number of hours, but NO MORE THAN 29 hours each work week, for the contract period. Employees occupying regular, part-time positions are eligible for pro-rata paid leave but NOT medical coverage. An individual employed in a regular, part-time position may be employed in other part-time positions at the same time, so long as the employee is working NO MORE THAN 29 hours in a workweek, with the advanced approval of the appropriate Dean or Director, Executive Team Member responsible for that area, and the Chief Human Resources Officer.
Note: Scheduling for 20 hours per week for more than 20 weeks in a fiscal year requires inclusion in the Arizona State Retirement System (ASRS).
Temporary Positions
Temporary, Full-Time: A position which is scheduled to work from 30 to 40 hours per work week for a fixed period of time with no expectation of continued employment. Employees occupying temporary, full-time are not eligible for medical coverage and can only be employed for periods of 14 to 90 consecutive calendar days. An individual employed in a full-time, temporary position may not be employed simultaneously in any other employment position with NPC. An individual who has been employed in a temporary, full-time position with NPC may not be employed in any other position (other than a regular, full-time position) with NPC until after a break in service of at least 26 consecutive work weeks occurs.
Temporary, Part-Time: A position which is scheduled to work NO MORE THAN 29 hours per work week for a fixed period of time with no expectation of continued employment. Employees occupying temporary, part-time positions are not eligible for medical coverage and can only be employed for periods of 14 to 300 consecutive calendar days. An individual employed in a part-time, temporary position may not be employed simultaneously in any other employment position with NPC. An individual may be employed in more than one temporary, part-time position at a time so long as the employee is working NO MORE THAN 29 hours in a work week, with the advanced approval of the appropriate Dean or Director, Executive Team Member responsible for that area, and the Chief Human Resources Officer.

Adjunct Faculty: A temporary, part-time position which is approved to work all or part of any semester. Employees occupying adjunct faculty positions are not eligible for medical benefits and are limited to teaching maximum of 12 credits per semester (9 in Summer). An individual may be employed in other temporary, part-time positions at a time so long as the employee is working NO MORE THAN 29 hours in a work week, with the advanced approval of the appropriate Dean or Director, Executive Team Member responsible for that area, and the Chief Human Resources Officer. Adjunct hours worked in a work week are determined by multiplying the number of credits taught by 2.25.

Federal Work Study Positions: A position scheduled to work part-time for a fixed period of time and is filled by a NPC student being paid through the Federal Work Study program. Students occupying Federal Work Study positions are not eligible for medical coverage through NPC. The hours worked by students in Federal Work Study positions do not count as hours of service for ACA purposes. Students in Federal Work Study positions may be employed simultaneously in other employment positions at NPC. The rules applicable to those positions apply to these students. All hours worked by Federal Work Study students count toward eligibility for overtime.
